Is Fertility a Disability?
Many of you have heard of the Americans with Disabilities Act ("ADA") that requires certain accommodation of people with disabilities at their place of work.

In one case, a woman in Louisiana was let go when she refused to work a full schedule so she could undergo fertility treatment.

The ADA defines a disability as a physical and mental impairment that substantially limits a major life activity.  The employee in this case said reproduction was a major life activity.  How would you rule?

The Court said the ADA listed such things as walking, seeing, speaking, breathing and working as major life activities, because a person must do these things throughout the day -- day in and day out.

However, the Court said a person is not called upon to reproduce throughout the day, every day.


Joke of the Month
A doctor, an engineer and a lawyer were arguing about whose was the first profession.

The doctor said medicine was first because Eve was made from Adam's rib and a doctor was needed.

The engineer declared someone had to build the Garden of Eden so an engineer had to be first.

The lawyer said before the Garden of Eden, there was chaos, and who else could be responsible for that?


Smoking Suit?
If you ignored your doctor's advice to quit smoking, you are eligible to join a class-action suit in Louisiana that accuses tobacco companies of manipulating nicotine levels to hook smokers.  Approximately 50 million people may be eligible, and the best news is you do not need a note from your doctor.


Did You Know?

• If you die in New Hampshire without a will, roughly speaking, your spouse gets only HALF of your estate.  Your kids are entitled to the rest.  Wills just aren't for the rich!
  
• If you had your license suspended after failing a breath test, you might be able to avoid criminal trial for DWI because of "double jeopardy."
  
• A pension is a marital asset and your spouse is entitled to a share of it, even though you may not retire for another 20 years.
  
• Geography plays a big part when it comes to how much an injured worker receives under workers' compensation.  The loss of a foot in Maryland brought a recovery of $123,543.  That same injury in Massachusetts was worth only $15,756.
  

I Rest My Case
In Iowa, an exotic dancer at a cocktail lounge can collect workers' compensation for a drunk driving accident she had an hour after she left work.

Because her job required her to persuade customers to buy her drinks, her accident was "work-related" and her employer was held accountable.
