Why You Can't Sue a New Hampshire Ski Area RSA 225-A:24 basically puts the responsibility for any downhill accidents on the skier and not the ski area. However, many people are injured because out of control skiers run into them. If that happens, you may have a claim against the skier that hurt you. In fact, in some Western states, some individuals have been charges criminally for reckless conduct and even child abuse.
